These Terms and Conditions govern your use of personal training services provided by CoachWhitt. By purchasing any service from us, you agree to be bound by these Terms.

1. About These Terms

1.1 Introduction

These Terms and Conditions ("Terms") govern your use of personal training services provided by CoachWhitt, a sole trader business operated by Dean Whittingslow ("we", "us", "our").

By purchasing any service from CoachWhitt, you ("you", "your", "Client") agree to be bound by these Terms.

1.3 Agreement to Terms

By completing the Pre-Exercise Health Screening & Informed Consent form and making payment, you confirm that you have read, understood, and agree to these Terms.


2. Services

2.1 Service Offerings

We offer personal training services as described on our Services page (www.coachwhitt.com/services.html). Our current offerings include:

  • Performance Plus (Online Coaching) - Personalised training programme delivered online, weekly check-ins, form reviews, programme adjustments, and access to private client support group
  • Elite 1-to-1 (Face-to-Face Coaching) - All benefits of Performance Plus plus in-person training sessions at agreed location

Pricing and service details are stated on our Services page and may be updated from time to time.

2.2 Founding Member Rates

If you signed up during a Founding Member period, your promotional rate is locked in as stated at time of purchase, for as long as your subscription remains active. If you cancel and later re-subscribe, standard pricing applies.

2.3 Service Delivery

  • Performance Plus: Programmes delivered digitally sent to your email
  • Elite 1-to-1: In-person sessions at agreed location (your home gym, local gym, outdoor space) plus digital programme access
  • All services require you to complete a Pre-Exercise Health Screening (PAR-Q) and Informed Consent form before commencement

3. Pricing and Payment

3.1 Pricing Structure

Our services are offered as either:

  • Recurring subscriptions: Monthly recurring payments for ongoing coaching services
  • Non-recurring packages: One-time payments for session packages, workshops, or other services

Current pricing is displayed on our Services page and confirmed at time of purchase.

3.2 Payment Processing

  • All payments are processed securely via Stripe
  • We do not store your card details
  • Stripe is PCI-DSS compliant and adheres to UK and EU data protection standards

3.3 Initial Payment

  • Your first payment is taken immediately upon sign-up
  • Services commence within 24-48 hours of completed Pre-Exercise Health Screening & Informed Consent form

3.4 Recurring Payments

For subscription services:

  • Subsequent payments are taken automatically on the same day each month as your initial payment
  • Example: If you sign up on 15 January, payments are taken on the 15th of every month thereafter
  • You will receive an email receipt from Stripe for each payment

3.5 Failed Payments

  • If a payment fails, Stripe will automatically retry within 7 days
  • If payment fails after 3 attempts, your subscription will be suspended
  • Services resume immediately upon successful payment
  • You are responsible for ensuring sufficient funds are available

3.6 Price Changes

  • We reserve the right to change prices with 30 days' written notice
  • Founding Member rates and promotional rates are exempt from price increases (locked for life as per your agreement)
  • If you do not accept a price change, you may cancel your subscription (see Section 5)

3.7 No Refunds

  • All payments are non-refundable
  • No refunds for partial months or unused sessions
  • No refunds if you do not use the service during a billing period
  • Cancellation takes effect after 30 days' notice (see Section 5)

4. Your Responsibilities

4.1 Health Screening

You must:

  • Complete the Pre-Exercise Health Screening (PAR-Q) truthfully and accurately
  • Inform us immediately if your health status changes
  • Obtain written medical clearance from your GP if you answer "YES" to any PAR-Q question before training commences
  • Update your health screening annually (expires 12 months from completion date)

4.2 Following Instructions

You must:

  • Follow all exercise instructions carefully
  • Ask questions if you are unsure about any exercise
  • Stop immediately if you experience pain, dizziness, or discomfort
  • Report any injuries or concerns to us within 24 hours

4.3 Equipment and Environment (Performance Plus)

For online coaching, you are responsible for:

  • Ensuring you have access to appropriate equipment
  • Training in a safe environment
  • Checking equipment for damage before use
  • Using equipment correctly as demonstrated

4.4 Session Attendance (Elite 1-to-1)

For face-to-face coaching, you must:

  • Arrive on time for scheduled sessions
  • Provide at least 24 hours' notice to cancel or reschedule
  • Sessions cancelled with less than 24 hours' notice are counted as completed (no rescheduling or refunds)
  • Repeated no-shows (3+ in a month) may result in subscription cancellation

4.5 Communication

You must:

  • Respond to check-in messages within 48 hours
  • Update your contact details if they change
  • Check your email regularly for programme updates
  • Maintain professional and respectful communication

5. Cancellation and Termination

5.1 Your Right to Cancel

You may cancel your subscription at any time with 30 days' written notice.


5.2 How to Cancel

To cancel:

  1. Email info@coachwhitt.com with subject line: "Cancellation Request"
  2. Include your full name and email address used for sign-up
  3. We will confirm receipt within 24 hours

5.3 Cancellation Effective Date

  • Cancellation takes effect 30 days from the date of your email request
  • You will continue to receive coaching services during the 30-day notice period
  • Your final payment will be taken as scheduled during the notice period
  • After 30 days, no further payments will be taken

5.4 No Refunds Upon Cancellation

  • No refunds for payments already taken
  • No pro-rata refunds for partial months during notice period

5.5 Our Right to Terminate

We may terminate your subscription immediately if you:

  • Breach these Terms
  • Provide false information on health screening forms
  • Engage in abusive or threatening behaviour
  • Fail to pay (after 3 failed payment attempts)
  • Repeatedly miss sessions without notice (Elite 1-to-1)

Upon termination by us:

  • Your access to services ends immediately
  • No refunds for payments already taken
  • Any outstanding payments remain due

6. Liability and Insurance

6.1 Our Liability

We have public liability insurance covering £2 million for claims arising from our negligence.

We ARE liable for:

  • Death or personal injury caused by our negligence
  • Fraudulent misrepresentation
  • Any other liability that cannot be excluded under UK law

We ARE NOT liable for:

  • Injuries sustained while training independently (Performance Plus)
  • Injuries caused by your failure to follow instructions
  • Injuries caused by faulty equipment you provide
  • Injuries caused by pre-existing medical conditions not disclosed on your PAR-Q
  • Injuries caused by you exceeding recommended intensity without our instruction
  • Loss of income or opportunity costs
  • Indirect, consequential, or special damages

6.2 Limitation of Liability

To the maximum extent permitted by UK law:

  • Our total liability to you (excluding death/personal injury from negligence) is limited to the total amount you have paid in the 12 months preceding the claim
  • We are not responsible for losses that were not foreseeable to both parties when you signed up

6.3 Your Acknowledgment of Risk

You acknowledge that:

  • Physical exercise carries inherent risks
  • You voluntarily choose to participate
  • You are responsible for your own safety during independent training (Performance Plus)
  • You must inform us immediately of any pain, discomfort, or health changes

7. Intellectual Property

7.1 Ownership

All content provided to you (training programmes, written materials, videos, nutritional guidance) remains the intellectual property of CoachWhitt / Dean Whittingslow.


7.2 Your License

You are granted a personal, non-transferable, non-exclusive license to use the content for your own training purposes only.


7.3 Restrictions

You must NOT:

  • Share, distribute, or sell your training programme to others
  • Copy or reproduce content for commercial purposes
  • Modify or create derivative works from our content
  • Remove copyright or attribution notices

7.4 Social Media and Testimonials

You grant us permission to:

  • Share your progress photos (with your explicit written consent)
  • Use your testimonials in marketing materials (anonymised or attributed, as you prefer)
  • Feature your success stories on social media (with your consent)

You may withdraw this permission at any time by emailing us.


8. Data Protection and Privacy

8.1 Data Controller

Dean Whittingslow (trading as CoachWhitt) is the Data Controller for your personal data.


8.2 Your Rights Under UK GDPR

You have the right to:

  • Access: Request a copy of all data we hold about you
  • Correction: Request corrections to inaccurate data
  • Erasure: Request deletion of your data (subject to 7-year retention for insurance)
  • Portability: Request your data in a machine-readable format
  • Withdraw Consent: Unsubscribe from marketing at any time
  • Lodge a Complaint: Contact the Information Commissioner's Office (ICO)

9. Complaints and Disputes

9.1 Complaints Procedure

If you are unhappy with our services:

  1. Step 1: Email us at info@coachwhitt.com with details of your complaint
  2. Step 2: We will acknowledge your complaint within 48 hours
  3. Step 3: We will investigate and respond within 14 days
  4. Step 4: If you are not satisfied with our response, you may escalate to Alternative Dispute Resolution

9.2 Alternative Dispute Resolution (ADR)

If we cannot resolve your complaint, you may use an ADR service:

  • Centre for Effective Dispute Resolution (CEDR): www.cedr.com
  • Citizens Advice Consumer Service: 0808 223 1133

9.3 Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.


10. General Terms

10.1 Entire Agreement

These Terms, together with our Privacy Policy and your completed Pre-Exercise Health Screening & Informed Consent form, constitute the entire agreement between you and CoachWhitt.


10.2 Changes to Terms

We may update these Terms from time to time. Changes will be notified via:

  • Email to your registered address (30 days' notice)
  • Updated "Last Updated" date at top of this page

If you do not accept changes, you may cancel your subscription (see Section 5).


10.3 Force Majeure

We are not liable for failure to perform our obligations due to events beyond our reasonable control (e.g., pandemic, natural disaster, government restrictions).

Notices sent by email are deemed received within 24 hours. Notices sent by post are deemed received 3 working days after posting.


11. Consumer Rights (UK)

11.1 Consumer Contracts Regulations 2013

As a UK consumer, you have a 14-day cooling-off period from the date of purchase to cancel for any reason.

However: If you request that services begin immediately (by completing the Pre-Exercise Health Screening form and accepting your training programme), you waive your right to the 14-day cooling-off period for services already provided.

11.2 Consumer Rights Act 2015

You have the right to expect that our services are:

  • Provided with reasonable care and skill
  • As described in our marketing materials
  • Fit for purpose

If our services do not meet these standards, you may be entitled to a remedy (e.g., repeat performance, price reduction, or in extreme cases, refund).


11.3 Your Legal Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law. For advice, contact Citizens Advice: www.citizensadvice.org.uk


12. Frequently Asked Questions

12.1 Can I pause my subscription?

No, we do not offer subscription pauses. You may cancel with 30 days' notice and re-subscribe later (standard pricing applies).


12.2 Can I switch between services?

Yes, email us to request a service change. Changes take effect from your next billing cycle.


12.3 What happens if I move house?

For Performance Plus: No change. For Elite 1-to-1: If you move outside our service area, you can switch to Performance Plus or cancel.


12.4 Do you offer refunds?

No. All payments are non-refundable. You may cancel with 30 days' notice to stop future payments.


12.5 How do I update my payment details?

Log into your Stripe customer portal (link sent in your welcome email) or email us for assistance.


12.6 What if I'm not satisfied with the service?

Contact us immediately. We will work to resolve any issues. If you remain dissatisfied, you may cancel with 30 days' notice.


13. Acceptance

By completing payment for any CoachWhitt service, you confirm that:

  • You have read and understood these Terms and Conditions
  • You agree to be legally bound by these Terms
  • You have read and understood our Privacy Policy
  • You have completed the Pre-Exercise Health Screening & Informed Consent form truthfully

If you do not agree to these Terms, do not purchase our services.
